All content, visual design, source code and the open‑source toolbox delivered under Deliverable D4.1 are the exclusive property of the consortium, with IABG acting as the lead partner and holder of the contractual licence granted by ESA. In accordance with Section 5.1 of the Detailed Proposal, every result generated by the consortium is deemed Foreground Intellectual Property (FGIP) and contains no Background Intellectual Property; consequently, the consortium grants ESA an irrevocable, royalty‑free, worldwide licence to use, reproduce, adapt and disseminate the FGIP for the duration of the EU CRCF Regulation 2024/3012 and any related certification schemes. Where Background‑IPR is indispensable (e.g., proprietary libraries incorporated into the software package), such components are provided only as executable binaries and remain the property of their respective owners, but the resulting combined solution may be freely reused by end‑users under the open‑source licence specified in D4.1.
The website and all associated services are provided “as‑is”. The consortium makes no warranties, expressed or implied, regarding the accuracy, completeness or fitness for a particular purpose of the EO products, algorithms or datasets, and disclaims liability for any direct, indirect, consequential or special damages arising from their use, except where mandatory German law or the ESA contract precludes such exclusion. The agreement is governed by the laws of the Federal Republic of Germany and by the ESA contract provisions (including the ESA Framework on Personal Data Protection [AD‑1] and the CRCF‑related contractual clauses). Disputes shall first be attempted to resolve through informal negotiation between the parties; if unresolved, they will be submitted to arbitration under the ICC Rules in Munich, Germany, whose award shall be final and binding.
